Please read these terms carefully before using clarispot. By accessing or using our platform, you agree to be bound by these terms.
These Terms of Use ("Terms") govern your access to and use of clarispot, a platform connecting clients with expert consultants for professional consultations. These Terms constitute a legally binding agreement between you and clarispot.
By registering for an account, accessing our website, or using our services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you may not use our platform.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of the modified Terms.
Account Creation
You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials.
Account Types
clarispot offers two account types: Client accounts for those seeking consultations, and Consultant accounts for experts providing services. Consultants must provide valid credentials and undergo verification before offering services.
Account Responsibilities
You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach. You may not transfer or share your account with others.
Acceptable Use
Users must conduct themselves professionally and respectfully. Harassment, discrimination, or abusive behavior toward any user is strictly prohibited and may result in immediate account termination.
Prohibited Activities
You may not: (a) impersonate others or provide false information, (b) engage in fraudulent activities or scams, (c) violate intellectual property rights, (d) attempt to bypass security measures, (e) use automated systems to access the platform, (f) interfere with platform operations, or (g) conduct transactions outside the platform to avoid fees.
Content Standards
All content shared on the platform must be lawful, accurate, and appropriate. You may not post content that is defamatory, obscene, threatening, or infringes on others' rights. We reserve the right to remove any content that violates these terms.
Service Quality
Consultants must provide services professionally and to the best of their abilities. You agree to honor all accepted consultation bookings and arrive on time. Cancellations must be made according to our cancellation policy.
Credentials and Expertise
Consultants must accurately represent their qualifications, experience, and expertise. You agree to maintain valid licenses and certifications required for your profession. Misrepresentation may result in account suspension or termination.
Availability and Scheduling
Consultants are responsible for maintaining accurate availability schedules. You must respond to booking requests within 24 hours and provide timely updates if your schedule changes.
Professional Boundaries
Consultants must maintain appropriate professional boundaries with clients. You may not solicit personal relationships, request contact information outside the platform, or engage in activities outside your stated area of expertise.
Client Payments
Clients agree to pay the displayed consultation fees at the time of booking. All payments are processed securely through our payment providers. Funds are held in escrow until the consultation is completed.
Consultant Earnings
Consultants will receive payment after successful completion of consultations, minus our platform fee. Payments are released to your wallet and can be withdrawn according to our payout schedule. We charge a platform fee of 10% on each completed consultation.
Refunds and Cancellations
Clients may receive refunds for cancelled consultations according to our cancellation policy: Full refund if consultant cancels, full refund if cancelled 24+ hours before consultation,
Payment Disputes
Any payment disputes must be reported within 7 days of the consultation. We will investigate and make a fair determination. Our decision on payment disputes is final.
Platform Content
All content on clarispot, including text, graphics, logos, software, and design, is owned by or licensed to us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.
User Content
You retain ownership of content you upload (profile information, course materials, etc.). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it for platform operations and marketing.
Consultant Materials
Consultants retain ownership of their professional materials and expertise. However, recordings of consultations may be stored temporarily for quality assurance and dispute resolution, subject to our Privacy Policy.
Service Disclaimer
clarispot is a platform connecting clients with consultants. We do not provide consultations directly. Services are provided "as is" without warranties of any kind. We make no guarantees about consultation outcomes or consultant expertise.
Consultant Independence
Consultants are independent contractors, not employees or agents of clarispot. We are not responsible for the quality, accuracy, or legality of their services. Clients engage consultants at their own risk.
Limitation of Liability
To the maximum extent permitted by law, clarispot shall not be liable for any indirect, incidental, special, or consequential damages arising from platform use. Our total liability is limited to the amount paid by you in the 12 months preceding the claim.
Medical and Legal Advice
Consultations on clarispot are for informational and guidance purposes only. They do not constitute medical, legal, financial, or professional advice. Always consult licensed professionals for specific situations.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using clarispot, you also agree to our Privacy Policy.
By You
You may terminate your account at any time through your account settings or by contacting support. Upon termination, you remain liable for any outstanding obligations.
By Us
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or misuse the platform. We may terminate accounts with or without notice depending on the severity of the violation.
Informal Resolution
If you have a dispute, please contact our support team first. We will make reasonable efforts to resolve disputes informally and in good faith.
Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with Nigerian law. You waive your right to participate in class action lawsuits.
Governing Law
These Terms are governed by the laws of Nigeria. Any legal action must be brought in the courts of Lagos, Nigeria.
You agree to indemnify, defend, and hold harmless clarispot, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and clarispot regarding platform use.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
